Kochi : It is states’ Legislative Assemblies that decide how their universities function; the Governor must show constitutional responsibility and upkeep its dignity, said Law Minister P. Rajeev.
Article 32 of the Indian Constitution states that universities shall function as per laws passed by their respective State Assemblies. The university Chancellors wield only such powers as allowed by the Legislative Assembly. The Governor has no special powers. The Legislative Assemblies cannot decide on powers of the Governor. The Government does not decide that either.
The Central government and UGC possess right to suggest changes to university laws an Assembly might pass. Chancellor, Vice Chancellor and the university administration must all function in conformation with the laws passed by Legislative Assembly. The public has conffered rights of that order with the State Legislative Assembles,
The Governor lacks power to endlssly postpone Bills an Assembly might have passed. However, there exists right to send back those Bills, in which case, problems with the Bills must be called to attention. Then, if the Assembly goes ahead passing the Bill once again, the Governor is left with no option but to approve it.. Recent court rulings have amply clarified that the Governor must conduct affairs as per satisfaction of the Assembly rather than one’s personal gratification.
We have a democratic system here. Don’t we? Sate Assemblies draw strength on faith entrusted by the people. The Assembly functions complying with that. Let’s wait and watch what it is that Governor wishes to let on, said P. Rajeev.
