Kochi : The High Court on Wednesday turned down a plea seeking the cancellation of bail granted to BJP leader Padmarajan - a school teacher accused in Palathai child molestation case. The plea filed by the victim’s parents was rejected by Justice PB Suresh Kumar.
In their plea, the parents cited that despite there existing the child’s testimony and medico-legal examination certificate, the chargesheet deliberately excluded POCSO charges which culminated in POCSO court lacking powers to decide on the bail matter. The bail, they added, was granted to Padmarajan, without hearing the victim’s side in the case.
At the court that allowed Padmarajan his bail, the Crime Branch said there were inconsistencies in the girl’s testimony. However, since the alleged victim seemed to be mentally stressed, it needed time to evaluate her using services of an expert psychologist, the officials told the court. At that time Padmarajan had obtained his bail following a rejection by High Court earlier.
