Church Row: Court Refuses To Stay State Govt Ordinance For Burials

Kochi: The High Court on Friday refused to stay the state government ordinance that seeks to remove hindrance for burials at Orthodox-controlled churches.

In their petition questioning constitutional validity of the ordinance, the Orthodox faction argued that the state lacks powers to formulate ordinances under the Constitution’s Concurrent List. The court has meanwhile sent notice to govt for its response on the matter.

Early in 2020, the state govt brought out ordinance that said every Christian has the right to have his burial at the parish he belonged to.  The govt intervention came after there arose law and order situation, with Orthodox faction resisting Jacobite families’ attempts to have their family members buried at the cemetery of the church they once belonged to.
