New Delhi : The Delhi High court on Wednesday has delivered split verdict on a batch of Public Interest Lititgations(PILs) on whether rape inside marriage should be criminalised in India. In a 2 - 1 verdict, justices Rajiv Shakherder and C Harishankar gave dissenting judgements whle Justice Shakdher stood for criminalization of marital rape.
The petitions sought to challenge “martital rape exception” clause in Section 375 of Indian Penal Code(IPC) that does not consider forceful intercourse by a man with his wife, who is not under 15 years of age, as rape.
With the verdict now impasse, the matter will be heard by the Supreme Court.
