Kochi : The High Court on Monday refused to interfere with Lok Ayukta ruling on alleged diversion of Disaster Relief Fund. The Lok Ayukta Larger Bench will hear the case on 6th of June. The 2-member Bench had transferred the case to Larger Bench following divided view on whether the case was maintainable.
The peitioner, R. Sasi Kumar, had approached the High Court after the case was shifted to Larger Bench. There is no clarity just as yet on whether the Lok Ayukta has jurisdiction over decisions taken by a constitutional body such as Cabinet.
Backdrop : The case revolves around aid provided from the Chief Minister’s Disaster Relief Fund to families of former NCP State President Uzhavoor Vijayan, former MLA KK Ramachandran Nair and that of a policeman P Praveen who was killed in an accident.
Lok Ayukta and Upa- Lok Ayukta had differed on whether the petition actually fell under purview of the authority. The case is slated to be heard by 3-member Bench led by second Deputy Lok Ayukta Justice, Babu Mathew P Joseph.
