HC denies interim relief to ADGP's daughter from arrest

Kochi > Observing that she was equal to any other citizen, the Kerala High Court today declined to grant any interim relief to the daughter of a senior IPS officer from arrest for allegedly assaulting a police driver for being late in bringing the vehicle to pick her up after a morning walk. Considering the anticipatory bail plea of the woman, Justice Abraham Mathew observed that no special privilege can be given to the ADGP's daughter and adjourned the case to July 12.

During arguments, the government requested the court to transfer her plea to the same bench which has been hearing the driver's plea seeking quashing of the FIR against him. The woman opposed the plea made by the government. Opposing her plea, the police also submitted that the driver, Gavaskar, had sustained serious wounds on his nape in the alleged attack by the daughter of former Battalion ADGP Sudhesh Kumar.

The high court had yesterday extended by one month its interim order directing the police not to arrest the driver, facing charges of of assaulting the woman. The court had earlier also directed the police to produce the case diary of the two cases registered in this regard.

The police had also registered a case against the ADGP's daughter based on the driver's complaint. The high court had earlier restrained the police from arresting the police driver till July 4 on the basis of a counter-complaint filed by the woman, whom he had accused of assaulting him.

The court gave the direction while considering a petition by the driver seeking quashing of the FIR registered against him based on the counter-complaint. The woman had allegedly assaulted Gavaskar following a quarrel on June 15. A case was registered against her under charges of non-bailable offence. In his police complaint, the driver had alleged the woman had verbally abused him and hit him on his neck and shoulder with her mobile phone for delay in bringing the vehicle to pick her up after her morning walk
