Kochi : Rape accused Congress MLA, Eldose Kunapilli, is back home from his week-long hiding and will have to appear before District Crime Branch officials in Thiruvananthapuram tomorrow. Eldose, searched for by police, public and his partymen in recent days, surfaced after securing anticipatory bail on Thursday and is currently at his Arakuzha residence.
The anticipatory bail from Additional Sessions Court in Thiruvananthapuram comes tagged with strict conditions. The court ruling requires that Eldose to appear before Crime Branch withaout fail.
The Crime Branch will decide on further course of action based on what answers Eldose gives them tomorrow. The victim’s testimony and the evidences she provided are crucial in the case. As per court ruling, Eldose will have to handover the mobile phones he’s been using. The investigating officers will soon issue a formal notice in this regard.
Meanwhile, the prosecution is likely to appeal with High Court challenging the anticipatory bail granted to Eldose. A clear picture in this regard will emerge today.
Questioning can be carried out up to 7 at night, during the time in which, the officials may arrest him if necessary. In that case, Eldose should be let off on a bail of 2 sureties and Rs 5 lakhs.
Even so, Eldose may be kept in brief custody for purpose of evidence collection. Police also has powers to obtain evidences from Eldose including his signature. If there occurs instance of brief custody, the bail shall become temporarily suspended.
