New Delhi : The Supreme Court on Monday upheld 10 percent reservation for poor among upper caste. The verdict endorsing the Constitutional amendment was handed in a 3: 2 majority of the the apex court Constitution Bench. Opposing the idea was Chief Justice UU Lalit and Justice Ravindra Bhat.
The majority side held that reservation based on economic background does not challenge the essence of Constitution, while the Chief Justice and Justice Bhat held that it was contrary to the constitutional basis for reservation.
The verdict came over a batch of petitions challenging the 103 amendment to Constitution affected by the Central government that grants 10 percent reservation to candidates from poor background amongst the upper caste.
