Kochi : Rejecting Sabu M Jacob’s appeal to quash case against him, the High Court on Saturday ruled that proceedings may continue against the Kitex Garment MD over accidental death of a worker at the factory. The verdict was handed by Justice AA Siyadh.
Sabu was formally charged after one of his workers, PJ Ajeesh, died during work at the factory. The case lies with Kolenchery Magistrate Court that booked Sabu following the report from Factories and Boilers Inspector in Perumbavoor that there were lapses in safety in the accidental death that occurred on 24 May, 2014.
In his plea, Sabu argued that factory affairs did not fall under his direct purview as Managing Director, owing to which he should be acquitted of the charges. The court acknowledged the Prosecution submission citing there exists provisions to book the factor owner over safety lapses for his workers.
