New Delhi : The Supreme Court dismissed NIA petition seeking to overturn the default bail Bombay High Court granted to lawyer-activist Sudha Bharadwaj earlier on 1 Dec. Bharadwaj had secured the bail three years into her arrest in Bhima Koregaon case.
The Bench comprising Justice UU Lalit, Justice Ravindra Bhat and Justice Bela Trivedi observed there was no reason to interfere with the Bombay High Court ruling.
Sudha Bhardwaj secured bail citing that the Additional Sessions Court of Pune that allowed a 90-day extension for completing investigations was not competent authority to do that by virtue of lacking Special Court status under sect 22 of NIA Act. The Bombay High Court in the bail ruling directed here for appearance before the trial court on 8 Dec for completing bail formalities.
