Judges Holding Trials of MP/MLAs In Special Courts Shall Continue With Their Posts: SC

New Delhi : In a significant ruling, the Supreme Court on Monday said that judges hearing the criminal cases against MPs/MLAs in Special Courts should continue with their current posts at the time  until its further orders from the top court.. The direction will be subject to retirement or death of the judges holding trials of legislators, the judgment added.

Further in the ruling, the top court also said that no prosecution against MPs and MLAs shall be withdrawn without the permission of the High Court of the concerned state.

The judgment was handed by Bench headed by Chief Justice of India NV Ramana and Justices Vineet Saran and Suryakant over a plea filed on pendency of criminal cases against MPs and MLAs and seeking their expeditious disposal by setting up of Special Court.
