New Delhi : The Supreme Court on Tuesday issued notice on special leave petition filed by the State of Madhya Pradesh against the High Court restraining the government from taking government from taking coercive action against any person violating Sec 10 of Madhya Pradesh freedom of religion Act, 2021, The said law requires a person wishing to switch religion to first submit a declaration indicating willingness to the District Magistrate.
The Bench comprising Justices MR Shah and CT Ravikumar refused to stay the HC order.
The Bench observed the provisions of the law to be prima facie unconstitutional and directed the state to not prosecute adult citizens if the solemnise marriage of their own volition.
