Not Confessing Does Not Mean Not Cooperating; Confession To Police Is Not Even Evidence: SC

New Delhi : Cooperation with investigation does not mean the accused must confess to the investigating officer, observed Supreme Court.They are two different things; an accused is not obliged to confess to his crime to be considered as cooperating; besides confessions to police is inadmissible as evidence, the Bench comprising Justices BR Gaval and Sandeep Mehta observed.

The crucial observations came in a verdict that held Police and a magistrate guilty of Contempt of Court for arrest and remand of an accused overriding the interim anticipatory bail Order passed by the Supreme Court.

In the case, the magistrate had argued that the accused was held in remand for not “cooperating” with the investigation.
