New Delhi : The Supreme Court put on hold its judgment on whether a person can be charged with UAPA for merely being a meber of a banned organisation. The 3-judge Bench headed by Justice MR Shah are done with the hearing but have ;adjourned verdict.
In 2014, a two-member Bench headed by then Chief Justice Dipak Mishra had referred the file to current Bench. As per SC verdict of 2011, UAPA shall not be invoked for a person merely being a member of a banned organisation unless he engages or facilitates any act of terror.
The Central govt approached the apex court challenging that verdict, claiming it was contrary to government interests.
